Statutory Rights
The following terms and conditions do not affect your statutory rights as a consumer.

Product Availability
It is important to note that information about our products does not amount to an offer by us to sell the products on that basis. Rather, it is an invitation to you to make us an offer to purchase that product on that basis, therefore references to 'orders' placed by customers are deemed to be references to offers by such customers to purchase the relevant produce from us. Although we will endeavour to maintain to supply you with the item requested, sometimes we may be unable to fulfil an order. In this instance, you will be informed at the earliest opportunity. Product images displayed on the website may occasionally differ from the respective product names and descriptions, due to changes in packaging and/or availability. 

The prices quoted throughout our website are inclusive of UK VAT at the current rate. We reserve the right to change our prices at any time. There may be occasions where prices are incorrectly quoted or changed at short notice as a result of circumstances beyond our control. If this situation occurs you will be informed of the correct price by telephone or email as soon as possible and should you not wish to proceed, that part of your order will be cancelled. Please note that on occasions some colours or particular products are at a different price to others. This happens when we have discontinued a colour or older product and have therefore reduced the price. 

Cancellation of your Order
If after thelearningemporium.co.uk has accepted an order from you (acceptance will be communicated via e-mail on receipt of an order), and you wish to withdraw from the contract, you may do so by communicating with us immediately. If an item has been shipped then we cannot cancel the order and you will be required to return the item as normal. If you have already received the goods and they are unwanted, you must return the goods to us at your own cost and risk, using the enclosed returns form and instructions. Provided the goods are returned in the same condition as we supplied them to you, we shall reimburse all monies paid by you for those goods. 

Unsuitable or defective items may be returned for refund or exchange providing they are received within 14 days of the original delivery date in brand new, unopened/unused condition, in the original undamaged packaging and accompanied by the returns form from the parcel you received. 

We will consider the overall condition of the product being returned when making a refund. 

As soon as we receive your goods we will process your request for a replacement item or refund. We will notify you via email as soon as your request has been processed. We will deduct original postage costs incurred if items are sent back for a refund unless item is deemed faulty or if an exchange is required. 

You will need to pay the cost of returning goods to us unless the item is faulty. When returning an item we advise you get a certificate of posting and sufficient insurance from the Post Office. For more expensive items we also advise that a fully insured service is used e.g. Recorded Delivery for items up to £50 and Special Delivery for items above £50.

All refunds are applied to the credit/debit card used to make the original purchase unless otherwise notified. Refunds will be furnished within 30 days of the agreement to refund.

If you have requested a refund, or replacements of a lower value than the returned goods, a refund will be credited back to the card used to pay for the original order. We will let you know as soon as the refund has been processed. 

If you have requested replacements of a higher value, any difference due will be charged to the card used to pay for the original order.

We reserve the right to deduct our postage costs incurred in the original order from the refund given. This will not apply to faulty goods.

On goods we have specially ordered in at the request of a customer (goods we do not carry) we won't accept returns unless faulty. The only other occasion we would consider return is for exchange but the special order item would be subject to a handling and re-stocking charge. 

Thelearningemporium.co.uk will endeavour to deliver to you within the specified time. However, there may be instances when we cannot deliver within this time. If we realise that we cannot deliver to you within that time, we shall alert you as soon as possible to try to arrange another suitable time for delivery.

If you have any queries about the personal information we are holding in your name, please contact our team, who will be more than happy to review your account and update our records as required.

Safety & Security
Our website uses the latest secure server technology to ensure your information is protected to the highest standard, whenever you place an order or access your account information. The Secure Sockets Layer (SSL) software we use encrypts the information you input, ensuring that it is virtually impossible for unauthorised parties to read any information that you provide.

Once an order has been placed, we don’t store the details of your payment card, with the exception of the last four digits and a unique token reference provided by your card issuer. This eliminates the need for merchants, e-commerce sites and operators of mobile wallets to store sensitive payment card data on their networks and reduces the risk of fraud.

Use of ‘Cookies’
Cookies are small pieces of data or text files that are stored by your web browser on your hard drive. Cookies allow a website to personalise your shopping experience and let the website know when the user has returned for example. Our cookies do not contain any personal information about you however and are only used to determine your browser and user preferences for our site, to help enhance your browsing experience. However, if you prefer, you can set your browser software to not accept cookies. You should still be able to use our site without cookies enabled, but you may lose a certain level of functionality.

Thelearningemporium.co.uk reserves the right to abort access of our internet services if your behaviour is found to be discordant with these terms and conditions at any time.

No permission is given by thelearningemporium.co.uk in respect of the reproduction or use for injurious or commercial purposes of any brand names, product names, designs and any other material shown on the thelearningemporium.co.uk website in which intellectual property rights subsist. ALL RIGHTS RESERVED. 

Governing Law
These Terms and Conditions and your use of thelearningemporium.co.uk are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights.

This website and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.
